General Terms & Conditions of RWTH International Academy GmbH

   1. This abridged version of the General Terms & Conditions provides a summary of the detailed version below and is not intended as a substitute.
   2. These General Terms & Conditions form part of all RWTH International Academy education and training contracts.
   3. Registration is by post, email, fax or our electronic registration portal accessible through our website (www.rwth-academy.com). A contract is valid once the relevant participant contract has been signed (for Master’s courses) or once you have been sent confirmation of registration (for certified courses, seminars).
   4. The training courses are subject to a participation fee. Further details are given in the participant contracts.
   5. Interest will be charged for late payments.
   6. A cancellation fee is payable if you are unable to attend a training course. The fee varies, depending on when you inform us of your cancellation.
   7. A training course may be cancelled if insufficient participants are registered, in which case, we will offer an alternative course or refund the course fees.
   8. You may cancel your registration for a training course within two weeks of registration and any payments will be refunded.
   9. You will receive a certificate of attendance or confirmation of your qualification, depending on the training course.
  10. All the contents and media used in the training courses are protected by copyright. You may not copy, distribute or use the training materials for any purpose other than the course.
  11. Despite carefully selecting our instructors, we are not liable for the accuracy, timeliness and completeness of the training material or for losses or damages that arise as a result of using or distributing this material.
  12. We are only liable in cases of willful intent or gross negligence.
  13. These General Terms and Conditions are governed by and construed in accordance with the courts in Aachen.
  14. Personal data will only be used by us for organizational purposes and will be stored and used according to the legally binding regulations.
  15. Course participants are not allowed to take photographs or make recordings during the courses.
  16. Participants accept that photographs and video recordings made of them may be used by RWTH International Academy.

 

 

Detailed version

 

Scope

The following General Terms & Conditions cover the contractual relationship between RWTH International Academy and the participants attending training and education events such as courses and seminars (subsequently referred to as “courses“).
 

Registration/confirmation of registration

Please send us your registration by email, fax or telephone. You can also register using our electronic registration portal accessible through our website (www.rwth-academy.com). Your registration becomes legally binding when both parties have signed the contract sent to you or when you receive written confirmation from RWTH International Academy in response to your application. Each legally binding registration is subject to these General Terms & Conditions that you accept with the contract on signing.

Payments

The participation fee is due in full on receiving the invoice. Please pay by money transfer. Any costs incurred when transferring the fee must be covered by the participant. If the invoice is not paid, RWTH International Academy has the right to cancel the registration and offer the place on the course to someone else.
In the case of late payments, RWTH International Academy has the right to charge 5 % interest above the basic rate p.a. (§ 247 Abs. 1 BGB).

Cancellation policy

Participants may cancel their bookings in writing. In the event of a cancellation, RWTH International Academy will charge a one-off administrative charge of 50 Euros irrespective of the course as well as a cancellation fee depending on when the participant cancelled and which course was booked. Cancellation fees are calculated as follows:
    * Master’s courses: Cancellations made up to two months before the course begins do not incur any further charges. 50 % of the course fees will be charged for cancellations made after this date and up to four weeks before the course begins; 100 % of the course fees are due for cancellations made after this date.
    * Certified courses: Cancellations made up to four weeks before the course begins do not incur any further charges. 50 % of the course fees will be charged for cancellations made between four and two weeks before the course begins; 100 % of the course fees are due for cancellations made up to two weeks before the course begins.
    * Seminars: Cancellations made up to two weeks before the seminar begins do not incur any further charges. 50 % of the course fees will be charged for cancellations made up to two weeks before the seminar begins; 100 % of the course fees are due for cancellations made once the seminar begins.
    * Non-attendance: 100 % of the course fees will be charged.
    * In general, a participant wishing to cancel a booking can name a substitute candidate who must be approved by RWTH International Academy. The substitute candidate may be refused the right to participate, depending on the course. Further details can be found in the confirmation of your registration / in your participant contract.
 

Cancellation at request of organizer / changes to program

If, contrary to expectations, too few participants are registered, RWTH International Academy has the right to cancel the course. In the event, participants will be informed immediately.
RWTH International Academy will suggest alternatives for cancelled courses, as far as this is possible and reasonable taking the circumstances into account (other dates, other venues). If the participant is agreed, he/she will be rebooked on the alternative course at no extra charge. If the participant is not agreed, he/she will be refunded in full any fees already paid. All further claims, particularly those related to travel and accommodation expenses or time off work, are excluded.
The same conditions apply if a course is cancelled at short notice e.g. if the course instructor falls ill (see above).
RWTH International Academy reserves the right to make changes to the organization, the staffing or the running of a course that have no major effect on the overall character of the course.

Right to cancel

You may cancel your legally binding registration without reason in writing (e.g. by letter or email) within two weeks of registering. The two-week period begins on the date you receive these instructions in writing or, in the case of services, not before the day the contract is signed and, for contracts in electronic form, not before we have had fulfilled our duty to inform according to § 312c Abs. 2 BGB in connection with § 1 Abs. 1, 2 and 4 BGB-InfoV and our duties according to § 312e Abs. 1 Satz 1 BGB in connection with § 3 BGB-InfoV. The deadline for cancellations is met by sending the cancellation off in time. Cancellations must be sent to:

Consequences of cancellation

In the event of an effective cancellation, any services received by either party must be reimbursed and compensation paid for usage (e.g. interest). Payments must be refunded within 30 days. The 30-day period begins for you on the date you send the letter of cancellation, for us on the date we receive it.
 

Confirmation of attendance / certification

After attending a course, participants will receive confirmation of participation from RWTH International Academy and, under certain circumstances, a certificate from RWTH Aachen or a certificate for passing a Master of Science exam.

Copyright

All training materials (whether on paper or in any other conceivable form such as video or audio material) are protected by copyright. The training materials and all other documents, graphics, images, sound recordings and other forms of information regardless of media provided by RWTH International Academy or our representatives may only be copied, distributed or used in any other way with the explicit written consent of RWTH International Academy.
 

Liability

The courses are carefully prepared and led by qualified authors and trainers. RWTH International Academy does not accept liability for the accuracy, timeliness and completeness of the training materials, the course contents and execution. RWTH International Academy also does not accept liability for the application or distribution of the matter covered in the courses nor any damages arising as a consequence thereof.
RWTH International Academy is only liable for physical and financial damages - irrespective of legal basis – as a result of willful intent or gross negligence.

 

Photographs & recordings

The participant agrees that photographs made during courses can be used, distributed and published by RWTH International Academy or its representatives in an edited or unedited form The right to use these images is not limited to specific areas, and allows for images to be used in advertisements and editorial publications for an unlimited period. The right to use these images also allows RWTH International Academy to sell and/or distribute them. The participant also agrees to this right being distributed.
Only those persons authorized or appointed in writing by RWTH International Academy may take photographs and/or make image and sound recordings of any kind during a course. Recordings/photographs made by other persons are strictly prohibited.
All participants have the right to withdraw their consent regarding the use of their photograph and/or recordings of other images or sound in writing at any time.
 

Jurisdiction

These General Terms and Conditions are governed by and construed in accordance with the courts in Aachen unless the participant is a natural person.
 

Data protection

The RWTH International Academy treats all personal data confidentially and only uses it in accordance with data protection legislation. Personal data will be stored and used for organizational purposes and in order to provide information in future about offers provided by RWTH International Academy. All participants have the right to withdraw their consent regarding the storage and use of their data in writing at any time.
